Spanish nationality by residence: periods and exams
Which residence period applies?
Article 22 of Spain’s Civil Code sets ten years as the general period, five for people granted refugee status and two for nationals of origin of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea or Portugal, and Sephardim. Brazilian and Portuguese nationals of origin may qualify for the reduced period; simply living in either country does not establish that status. Separate one-year categories exist, including certain birth, marriage and ancestry situations. Do not assume every relative of a Spanish citizen qualifies.
Residence must meet the legal test
Residence must be lawful, continuous and immediately before the application. Counting from your first arrival can be misleading, and a study stay should not automatically be counted as qualifying residence. Marriage to a Spaniard does not itself grant nationality. Good civic conduct and sufficient integration must also be established. Review your permit history and travel record; this guide does not offer a universal absence allowance or a guaranteed eligibility calculation.
DELE and CCSE are separate requirements
The usual requirements are DELE A2 or above and CCSE. The nationality-based exemption from DELE for specified Spanish-speaking countries does not automatically remove CCSE. Brazil and Portugal are not on that exemption list: the two-year residence category is not an exam exemption. DELE diplomas have indefinite validity; CCSE certificates are valid for four years. Certain official Spanish-language qualifications can provide alternative evidence under the prescribed conditions.
Exemption, waiver or accommodation?
Applicants under eighteen are exempt from both examinations, with the required integration evidence. Reading, writing or learning difficulties may support an individual Ministry waiver request, not automatic exemption. Cervantes examination accommodations and a Ministry waiver are different measures. Check the required sequence before applying for nationality; a pending waiver request does not simply allow you to omit examinations.
Application preparation and the grant
Check which certificates apply, their validity and any apostille, legalisation or translation requirements. Electronic filing is available through the Ministry, but should not be described as the only legally available route. A grant must be followed by the applicable Article 23 formalities and Civil Registry registration. Spain’s exceptions to a renunciation declaration do not by themselves settle the effect under another country’s nationality law. Meeting the period or passing exams never guarantees a grant.
